Terms and Conditions of video competition

By entering this competition you agree to be bound by the following terms and conditions (“Agreement”).

Eligibility

In order to be eligible for this competition you must be a UK Resident, 18 or over at the date of entry and not be employed by Payday Bank or PDB UK Limited (“PDB, We, Us, Our”) or any of its affiliated companies;

How to enter

Send us a clip lasting no longer than 1 minute and no less than 30 seconds. Use your video to tell us about how you would spend £300. All clips must be recorded in English and be in AVI, MPEG, WMV, or 3gp format. You should send your entry to us video@pdbuk.com The competition shall be open from 10/06/2011 to 31/07/2011. Payday Bank reserve the right to extend the closing date of this competition at our discretion but we shall post this on our site. Any entries received after the closing date will not be considered. Entries are limited to 1 per person. Multiple video submissions from 1 person will be counted as a single entry. Participation in our competition is free of charge and there is no purchase necessary. All entries must be verified and accepted by Payday Bank’s designated adjudicators and such adjudicators’ decisions (including without limitation verification of entries, selection of winners and allocation of prizes) will be final.

Prizes

1 x 1st prize of £300, 4 x runners up prizes of £50. All prizes are non-transferable, non-negotiable and non-refundable. Prizes will be sent to the winner and runners up in the form of a cheque sent by first class post within 14 days following their notification by PDB.

Winners

The winner and the runners up will be contacted by telephone or email by an adjudicator by 05/08/11. Should the adjudicator not be able to contact the winner within 14 days of 05/08/11 Payday Bank reserves the right to deem that participant’s entry invalid and will select the best runner up entry based on the same criteria. This entry shall then be declared the winner and another runner up shall be chosen and these shall be contacted as above. The adjudicators shall follow the same procedure as above for all prize winners who cannot be contacted. Should the adjudicator not be able to contact any or all of the runner ups the next best entries shall be chosen based on the same criteria as above. The names of all prize winners will be posted on the PDB’s Website on 01/08/11.

Submitting your film to PDB

By submitting your film to us you warrant and represent that you personally created, wrote and produced such content. You must not use any content which violates the intellectual property rights of any third party including but not limited to copyright, trademarks, patents, design rights, registered designs, trade secrets, logos, contract and licensing rights, rights of publicity, , moral rights, image rights or any other intellectual property rights. You agree that you are responsible for everything that you post or transmit to us and agree not to send us any content which contains reference to competing brands of PDB, unlawful, swearing, indecent images, scenes of violence, harassing, libellous, defamatory abusive, discriminatory (including without limitation race, sex, disability or age) or any other objectionable material. You agree not to transmit to us any viruses or files designed to damage or disrupt the good working order of any of our computers or server equipment. You agree not to impersonate any other person or entity and you will provide only true, accurate and complete information to us. Each entrant irrevocably grants PDB and its associated companies the exclusive, non-transferrable worldwide and free of charge and of royalty, rights to use develop, adapt and market all or any of the content submitted by you. You agree to waive your moral rights for the purposes of this licence. If you do not want to grant these rights, please do not submit your video to us. PDB reserves the right to disqualify any entry it deems as unsuitable for public viewing.

Your information

Any information you provide to us when submitting your entry will be held securely on our servers in accordance with our privacy policy. By submitting your entry to us you agree to grant us the right to use your name, picture, voice, biographical data, photograph, testimonial, or other likeness and/or prize information, and/or any information contained in your entry for the purposes of promoting the services offered by PDB and/or its affiliates. By entering this competition you agree to PDB notifying you about important changes to our website, new services, and special offers we think you will find valuable. We may also use your data, or permit selected third parties to use your data, to provide you with information about goods and services which may be of interest to you and we or they may contact you about these by electronic means, post or telephone. You may notify us at any time if you no longer wish to receive details of special offers by emailing us at feedback@pdbuk.com.

Intellectual Property rights

PDB UK and Paydaybank is the trade mark of PDB UK Limited. You must not use any of our trademarks in any way without our prior written consent. All content contained on PDB’s websites is the property of PDB and must not be copied for any reason without the express prior written consent of PDB.

Liability

Unless expressly stated to the contrary, PDB shall not be liable for any indirect or consequential loss of any kind in contract, tort or otherwise arising out of this Agreement or in relation to the goods and/or services that we provide. Nothing in this Agreement shall operate to limit or exclude liability for fraudulent misrepresentation, death or personal injury caused by negligence of PDB. By submitting your entry to us you agree that PDB’s liability to you under this Agreement shall be limited to £500. PDB shall not be liable for (without limitation) any internet failure, software failure, non transmission to or non receipt by PDB of video entries. PDB shall not be liable for non receipt of prize by any winner or runner up for any reason including but not limited to incorrect address details provided by the winner, loss or damage of prizes in the post. PDB reserves the right to change, suspend or cancel the competition without specifying reasons and without incurring liability as a result, and to change these terms and conditions and/or the prize by posting notice on the website (effective from the date and time of posting). You agree to indemnify PDB against any and all claims, demands, losses, damages, liabilities, costs and expenses arising out of or by reason of any breach by you of these terms and conditions.

Disclaimer

Only entries which are received by PDB and comply with these terms and conditions shall be valid entries. Any entry which is illegible, incomplete, or which is not submitted in the manner set out in these terms and conditions may be deemed invalid at the sole discretion of PDB and may be rejected. The Adjudicators’ decisions are final.

General

Your use of the Site and/or its content creates no partnership, employer/employee, client, fiduciary or other professional relationship with PDB. This Agreement constitutes the entire agreement between the parties and supersedes all prior communications, drafts, agreements, representations (other than those made fraudulently), warranties, stipulations and undertakings of any nature, whether oral or written between the parties. If any provision of this Agreement is held by any court or other competent authority to be illegal, invalid, in conflict with any relevant law or unenforceable in whole or in part, the other provisions of this Agreement and the remainder of the affected provision shall remain valid. PDB may vary this Agreement from time to time. We shall inform you of any such variations by posting the new terms on our site. Your continuing to use our site or services will constitute your agreement with and acceptance of any such amendment or other changes. This Agreement shall be governed by the laws of England and Wales and the parties each submit to the exclusive jurisdiction of the English courts.
